End User Licence Agreement (EULA) - CutAssist and PixAssist
Version 1.0 | Effective from: [SALES START DATE]
This document sets out the terms on which you may use CutAssist and PixAssist. Please read it before installing. By starting to use the Software you accept these terms.
1. Who is who
Licensor (we, us): Dominika Kuś, a sole individual trading as an unregistered business, Poland. Contact: support@buildwith.it
Seller: Lemon Squeezy, LLC (United States) acts as the Merchant of Record. Your purchase contract for the subscription is with Lemon Squeezy, which issues the purchase document and handles payments. Their terms: https://www.lemonsqueezy.com/buyer-terms
This licence governs your use of the Software only. It does not replace or limit the Lemon Squeezy terms of sale.
2. What the licence covers
"Software" means, depending on the product you purchased:
- CutAssist - an assistant for Adobe Premiere Pro and Adobe After Effects,
- PixAssist - an assistant for Adobe Photoshop and Adobe Lightroom Classic,
together with the panel inside the Adobe application, the local bridge server, the command line tools, the user documentation and the built-in knowledge base, and all updates released during your subscription period.
CutAssist and PixAssist are separate products with separate subscriptions. A licence key for one product does not work in the other.
3. What you may do
We grant you a non-exclusive, non-transferable, worldwide licence for the term of your paid subscription, which covers:
- installing and running the Software on up to 2 computers at the same time (the limit is enforced by the licence server; you can free a slot by deactivating the licence on a given computer),
- using the Software for your own purposes, including commercial ones - in work for your clients and in your own business,
- making a backup copy of the installation package.
Your work is yours. We claim no rights to the edits, graphics, photographs, projects or any other material you create using the Software. We do not require you to credit us.
4. What you may not do
- resell, rent, lease or otherwise make the Software available to third parties,
- share or resell your licence key, including publishing it,
- grant sublicences,
- circumvent, disable or modify the licensing mechanism,
- remove authorship notices, licence information or the third-party licence files,
- present the Software as your own product.
Statutory reservation: the above restrictions do not affect your rights under article 75(2) of the Polish Act on Copyright and Related Rights (including reproduction of code to achieve interoperability with other programs). Under article 76 of that Act these rights cannot be excluded by contract, and we do not attempt to do so. Where your local law grants you equivalent non-waivable rights, those rights prevail over this clause.
5. What the Software needs in order to work
These are characteristics covered by the contract within the meaning of article 43b of the Polish Consumer Rights Act. If your environment does not meet them, the Software may not work, and that is not a lack of conformity.
Common to both products:
- operating system: Windows 10 or Windows 11, or macOS 26 on Apple Silicon (tested: macOS 26.3.1, Apple M4 Pro),
- Node.js version 20 or newer,
- your own paid Claude plan from Anthropic (Claude Code requires at least the Pro plan). You buy and pay for the Claude plan separately, directly from Anthropic. It is not included in the price of our subscription and is outside our control,
- internet access for activation and for periodic licence validation (see section 6).
CutAssist additionally:
- Adobe Premiere Pro or Adobe After Effects. Tested and supported versions: 2026 (26.x). The installer also accepts older versions (Premiere Pro from 14.0, After Effects from 17.0), but we do not test them and our conformity undertaking does not cover them,
- some operations performed through the application interface require the Adobe interface to be set to English. The Software tells you how to switch the language where this is needed.
PixAssist additionally:
- Adobe Photoshop 2026 (27.x, tested: 27.10 and 27.11) or Adobe Lightroom Classic (tested: 15.5.1 and 15.6),
- some features use Adobe's AI features, which run in the Adobe cloud on your own Adobe account. You enable them yourself in the Adobe application settings. Their availability, limits and any Adobe-side costs depend on your Adobe plan.
Your Adobe licence and Adobe plan are not included in our price.
Differences on macOS. Both products work on macOS, but three things behave differently there and we say so openly:
- on first use macOS asks for system permissions (Accessibility, Screen Recording, file access and Automation). Until you grant them, interface-driven operations wait, and the first launch of an Adobe application can take several minutes,
- PixAssist on macOS does recognise the system's permission windows (file access, Automation, Accessibility, password) and tells you exactly what to click so the operation can continue. It does not, however, read the contents of Photoshop's or Lightroom Classic's own dialog windows, nor press buttons in them. In that situation the assistant asks you to look at the application and answer the dialog yourself instead of doing it for you. All other Photoshop and Lightroom Classic features work,
- CutAssist on macOS: operations in After Effects that use the Tracker and Preview panels require those panels to be expanded. On screens of limited height (for example 14 inches) the default layout collapses them to their buttons alone, and such operations return an error. This depends on your panel layout rather than on the operating system itself.
6. How the licence works
We state this openly, because it affects how you use the product:
- Activation. On first run the Software contacts the Lemon Squeezy licence server and sends your licence key and a randomly generated device name (not your computer's name). In return it receives an instance identifier and the key status.
- Validation. The licence status is refreshed every 3 days.
- Working offline. The licence remains valid for 30 days from the last successful validation. No internet connection, a timeout or a licence server failure will not block your work within that window.
- End of subscription. When the subscription expires or is cancelled, the tools that act on Adobe applications are blocked. Status checks, licence handling, the knowledge base and the documentation keep working, and the Software shows a clear message explaining what happened and where to renew.
- Changing computers. To move the licence, deactivate it on the old computer (the deactivation command, or uninstalling with the data purge option). This frees one of the two slots.
The Privacy Policy explains exactly which data is processed in this.
7. What the Software does to your files - please read
The Software carries out instructions that you phrase and that your chosen AI model interprets. In carrying them out, the Software changes, saves, overwrites and deletes project items, layers, files and settings in Adobe applications.
Three things follow from this:
- The AI model can get it wrong - understand an instruction differently from how you meant it, or do more than you wanted. The decision to accept a change is yours.
- Keep backups. We recommend working on copies of your projects and keeping version history on. This is a condition of using a tool that edits files sensibly.
- The safeguards we built in: CutAssist saves a project by default before closing it, or refuses to close it while there are unsaved changes. PixAssist works non-destructively: results land on new layers, masks and adjustment layers, and saving goes to a copy of the file by default, not over the original.
Safeguards reduce the risk; they do not remove it.
8. Artificial intelligence
- The Software contains no AI model of its own. You choose and pay for the model (Claude from Anthropic).
- We do not use your data or the results of your work to create, train, test or improve AI models. This includes material produced in Adobe applications.
- Some PixAssist features use Adobe's AI features in the Adobe cloud, on your account, once you enable them.
- The Software makes no decisions on your behalf that produce legal effects. It is a working tool under your control.
9. Updates and changes to the product
- For the whole paid subscription period you receive updates at no extra cost, including bug fixes and security updates (article 43k(4) of the Polish Consumer Rights Act).
- We may change the Software's features only for justified reasons, such as changes in Adobe applications, in providers' APIs, legal requirements or security. We give advance notice of material changes (article 43m of the Polish Consumer Rights Act). If such a change materially and adversely affects your access to the Software, you may terminate the subscription.
- A known change, announced in advance: the CutAssist panel in Premiere Pro uses CEP technology, which Adobe has announced it will retire (no date given). When that happens, we will ship a UXP-based version as part of the updates covered by the subscription.
10. Conformity and complaints
If you are a consumer, or a sole trader treated as a consumer under Polish law, you have the rights set out in chapter 5b of the Polish Consumer Rights Act (lack of conformity of digital content with the contract). We do not limit those rights. If your local consumer law grants you broader rights, those apply.
- Complaints about the purchase, payment and invoices go to the seller, Lemon Squeezy.
- Complaints about how the Software works can be sent directly to us: support@buildwith.it. We reply within 14 days.
Please include: the product, its version, your operating system, your Adobe application version, what should have happened, what happened instead, and the log if you have it.
11. Liability
If you are a consumer, or a sole trader treated as a consumer: we are liable on the terms set out in the applicable law. We neither exclude nor limit that liability. No provision of this licence may be read as limiting your statutory rights.
If you buy as a business (a purchase directly connected with your professional activity and of a professional character for you):
- our liability is limited to the total subscription fees you paid for the product concerned in the 12 months preceding the event,
- we are not liable for lost profits,
- these limits do not apply to damage caused intentionally (article 473(2) of the Polish Civil Code), to gross negligence, or to personal injury.
In all cases we are not liable for:
- the operation, outages, changes and policies of Adobe, Anthropic and Lemon Squeezy, including the costs and limits of your plans with those providers,
- the consequences of you disabling safeguards, working without backups, or using the Software in an environment that does not meet the requirements in section 5,
- the content you create using the Software, or its compliance with the law and with third-party rights.
We neither exclude nor limit liability for a defective product to the extent that mandatory law provides for it.
12. Security and reporting vulnerabilities
The Software runs a local bridge server on your computer, protected by an access token stored in a file readable only by your user account. Connections originating from web pages are rejected.
Report vulnerabilities to: security@buildwith.it. Please include step-by-step reproduction, the Software version and your operating system. We respond within 72 hours and we will not take legal action against anyone who reports a vulnerability in good faith without accessing other users' data.
Declared support period for security updates: 5 years from the release date of the given major version - in line with Regulation (EU) 2024/2847 (Cyber Resilience Act).
13. End of the licence
- The licence expires at the end of the paid subscription period.
- In the event of a material breach of section 4 we may terminate the licence after asking you to stop the breach and 14 days have passed from that request without effect.
- If we discontinue the Software or change the licensing provider, we will supply existing licensees with a build that works without online validation, or another solution that keeps their access for the paid period.
- When the licence ends, please remove the Software. You may keep the results of your work - they are yours with no time limit.
14. Trade marks and no affiliation
CutAssist and PixAssist are not affiliated with, endorsed, sponsored or approved by Adobe Inc. or Anthropic PBC.
Adobe, Adobe Premiere Pro, Adobe After Effects, Adobe Photoshop and Adobe Lightroom Classic are trade marks of Adobe Inc. Claude is a trade mark of Anthropic PBC. We use these names solely to indicate what our product is for.
15. Third-party components
The Software includes open source libraries under the MIT, ISC and BSD licences. The list and the licence texts are in the THIRD-PARTY-NOTICES file in the installation package. We do not distribute ffmpeg - if you need it, you install it yourself under its own licence terms.
16. Governing law and disputes
This licence is governed by Polish law.
If you are a consumer, you keep the protection given to you by the mandatory rules of the law of your country of habitual residence (article 6 of the Rome I Regulation). You also have access to out-of-court complaint and redress procedures, including the European Union online dispute resolution platform.
Disputes with businesses are heard by the court having jurisdiction over the Licensor's place of residence.
17. Changes to this licence
We will notify you of any change to this licence at least 14 days before it takes effect, by email to the address linked to your purchase or in the product panel. If you do not agree to the change, you may terminate the subscription before it takes effect. Purchases made before that date remain governed by the version of the licence in force on the date of purchase, unless the change is required by law.
18. Language versions
This licence is provided in English and Polish. The English version is the binding one. For consumers habitually resident in Poland, the Polish version is binding.
