Trial, Cancellation and Refunds - CutAssist and PixAssist
Version 1.0 | Effective from: [SALES START DATE]
Short and with nothing hidden: what you get, when we charge you, how to cancel and when we refund.
1. What you are buying
A subscription to one of the products: CutAssist or PixAssist. Available plans: monthly and yearly. Each starts with a 7-day free trial.
The seller is Lemon Squeezy, LLC, acting as Merchant of Record. Payments, purchase documents and the mechanics of refunds are handled by Lemon Squeezy. The licensor of the software is Dominika Kuś.
2. The trial: 7 days, card required
- Starting the trial requires your card details. Nothing is charged at that point.
- The clock starts when you complete checkout, not when you first run the plug-in. Your licence key and files are emailed to you immediately, so start the installation the same day.
- The first payment is taken on day 8, automatically, at the price shown before purchase ($20 per month or $199 per year, unless you used a discount code).
- Lemon Squeezy emails you a reminder before the trial ends and the charge is taken.
- To avoid being charged, cancel before the end of day 7 in the customer portal. We recommend doing it at least 48 hours before the trial ends: the Lemon Squeezy terms allow for that much notice before the end of a period.
- Cancelling during the trial ends your access when the 7 days are up and results in no charge at all.
3. How to cancel
In the Lemon Squeezy customer portal; you will find the link in your purchase email and on the product page. Cancellation takes effect immediately and requires no contact with us and no reason.
After cancelling you keep access until the end of the period you have paid for. If you cancel halfway through a yearly plan, the software keeps working until the end of that year.
4. Refunds: the rule
We do not refund an unused part of a subscription period, nor a trial you forgot to cancel.
The reason: the price after the trial, the length of the trial and the cancellation deadline are stated next to every purchase button, before you enter your card details, and a reminder email arrives before the charge. Access after cancelling runs to the end of the period you paid for, so none of the paid time is lost.
5. Refunds: when we do refund
We refund if:
- there has been a double charge or another payment error,
- the software does not start because of a fault on our side and we cannot fix it within a reasonable time of your report,
- the software does not conform to the contract within the meaning of the rules on digital content, and bringing it into conformity is impossible or would cause disproportionate difficulty. In that case you have a statutory right to a price reduction or to terminate the contract, regardless of the rule in section 4,
- the subscription renewed after you told us you were cancelling and the system failed to register it.
We ask for no justification in these cases: they are situations where something went wrong.
6. Right of withdrawal (consumers)
The software is digital content supplied without a tangible medium. At checkout you consent to performance beginning before the withdrawal period ends and acknowledge that you thereby lose the right of withdrawal (article 38(1)(13) of the Polish Consumer Rights Act, implementing the Consumer Rights Directive).
If you did not give that consent, you have 14 days to withdraw from the contract without giving a reason. Send your statement to support@buildwith.it or to Lemon Squeezy. The refund is then made within 14 days, using the same payment method.
The right of withdrawal arises once, at the start of the contract. Moving from the trial into the paid period does not create it anew, because the post-trial price was disclosed to you before the contract was concluded.
If the mandatory consumer law of your country of habitual residence gives you broader rights, those rights apply.
7. Lemon Squeezy's own decision
Lemon Squeezy, as the seller, may refund a payment on its own initiative within 60 days of the transaction, including contrary to the rule in section 4, where it considers that justified. We have no control over such decisions.
8. Card disputes (chargebacks)
If you believe a charge was wrong, write to us first: support@buildwith.it. We reply within 14 days and, in the cases described above, we refund without argument. A bank dispute means your licence account is suspended until the matter is resolved, which is slower for both sides.
9. Contact
support@buildwith.it - refunds, payments, cancellation, licence problems. We reply within 14 days, usually sooner.
Please include: the email address used for the purchase, the product name and the transaction date.
